Yamaha Sued Over Dry Exhaust Defect In Its Model Year 2000-2005 Yamaha F225 Four Stroke Outboard Boat Motors

Yamaha

yamaha

The lawsuit is brought on behalf of a class of current and former owners of Model Year 2000-2005 Yamaha F225 four stroke outboard boat motors (“Class Motors”) with defective dry exhaust components (the “Defect” or “Dry Exhaust Defect”).

This action arises from Defendant’s failure, despite its longstanding knowledge of a material design defect, to disclose to Plaintiff and other consumers that the Class Motors are predisposed to corrosion-based failure. The Dry Exhaust Defect—which frequently manifests shortly after the limited warranty period has expired—will inevitably cause a substantial portion of the Class Motors to fail. Once the Dry Exhaust Defect manifests in the Class Motors, they must undergo expensive repairs to remain operable.

Significantly, when the Dry Exhaust Defect occurs it poses a safety risk to the operator and passengers of the boat. The Dry Exhaust Defect can cause reduced performance and maneuverability, as well as a significant risk of breakdown at sea, with all the risks inherent in such situations.

The complaint claims that not only did Yamaha actively conceal the fact that particular components within the dry exhaust system are defective (and require costly repairs to fix), they did not reveal that the existence of this defect would diminish the intrinsic and resale value of the Class Motors and lead to the safety concerns described within.

For customers with vehicles within the written warranty period (which extends for 3 years), it appears Yamaha has made repairs following failures. However, because gaining access to the corroding area often costs several hundred dollars and it is not visible without this expensive effort, these engines are corroding during the warranty period unbeknownst to many thousands of Class Motor owners.

Yamaha has refused to take any action to correct this concealed design defect when it manifests in Class Motors outside the warranty period, despite the fact that substantial corrosion—leading directly to the failures—is occurring during the warranty period. Since the Dry Exhaust Defect typically manifests shortly outside of the warranty period for the Class Motors

Despite notice and knowledge of the Dry Exhaust Defect from the numerous consumer complaints it has received, information received from dealers, an article published by USBoat, and its own internal records, Yamaha has not recalled the Class Motors to repair the Dry Exhaust Defect, offered its customers a suitable repair or replacement free of charge, or offered to reimburse its customers who have incurred out of pocket expenses to repair the defect.

As a result of Defendant’s unfair, deceptive and/or fraudulent business practices, owners of Class Motors, including Plaintiff, have suffered an ascertainable loss of money and/or property and/or loss in value. The unfair and deceptive trade practices committed by Defendant were conducted in a manner giving rise to substantial aggravating circumstances.

I have a 2005 that has been repaired twice now due to corrosion issues. The first time the "repair kit" was not readily available nor cheap. That was a $2000 repair, and now 3 years later the problem is occurring again. I am faced to pay about $2500 this time. I would love to see Yamaha own up and pay for the parts and at the very least half the labor cost.

I thought I dodged a bullet with my 2 2005 F225 engines. Well not so much, 1345 hours and both motors need the repair. It amazes me that this has been an known issue and a recall has not been issued. It is a shame, these motors have been nothing but excellent for 9 years. I have another Yamaha motor and now I am starting to wonder about the quality.

I have 2005 twin F225 engines.. with 324 hours pampered and well maintained. Certified mechanic just informed me that both engines required exhaust kits, estimated repair kit / labor $5000.00 Mechanic told me this was inherient with Yamaha four strokes. After research, I'm shocked to learn of countless complaint validating this same design flaw. While I have no remedy for others, I will be glad to join in this complaint.

One of my 2002 F225's failed after only 470 hrs but it was out of warranty so it was an out of pocket repair to the tune of 2k. The thing that bugs me the most about this is I paid a permium for these new technology 4 stroke engines and they are now looked at as undesireable by anyone knowledgeable in the boating industry so resale value is the same as or les than 2 stroke power.

I have 2 2004 Yamaha F225s that have both been effected by significant corrosion. The first motor that was corroded could not be repaired according to my mechanic so I had to replace with a used one (2005). Now the second suffered corrosion issues that required a new power head to be installed. Still my mechanic has told me the new power head will not last long. Ultimately I am going to need to re-power this boat as a result of Yamaha's unwillingness to recognize the issue and address it.

Yamaha told me, they plan on doing nothing about it. I won't give Yamaha another dime. I retired with the thought I was buying a quality product. Here is the issue. I spent $8000 on doing both engines in 2011. The corrosion is back. So you will spent $3/4 per motor and Yamaha are still using parts with a built in life on a non serviceable part. Making money by the back door Yamaha is not cool.
Suzuki is doing some good deals and standing behind their product. Yamaha is a poor company.

I have twin 2005 F225 four strokes on my boat. had to replace an entire power head on one, $8000.00, and the second was running funny so I had a mechanic inspect it to fix the issue. I am very meticulous and rinse these baby's every time I pull it out of the water. The corrosion inside was horrible. The rinse port on the side of the engine is by all accounts what Yamaha reps say to use to rinse the engine for 15-20 min. I am looking at possibly another several thousand dollars to repair the second one and I am ready to join the lawsuit!

All,

I have tried to deal directly on this. Here is what I know.
You won't get through to anyone that will admit anything.
They know there are class actions against them.
They refuse to admit they changed the specs on the kit first 'fix kit' which they don't say is a kit but rather a set of components.
They will try everything to say the issue is down to user issues due to poor maintenance.
The CEO's name is Ben Speciale and he is well protected. They will not put calls through to him and I had to force them to give me his contact details. Not the actions of an organization that puts the customer first. I should imagine e is hiding on his lawyers advice.
His email address is ben_speciale@yamaha-motor.com. He won't reply direct but get his team to call you but you have to really hit him hard.
They know there is a big issue but they are going to fight this all the way.
Until someone dies at sea due to an engine failing 40 miles out at sea they are going to run and hide.
Structurally the way they are set up, Yamaha motors USA is a separate legal entity from the Japanese parent company. Gives the separation to protect Yamaha Japan financially.
They have twisted and turned and cost people a fortune rather than msn it up and admit a technical design and specification fault.
I would hit them with emails as a start...

2004 Yamaha 4 stroke, inspected today, pulled lower unit and boroscopes. Starting to corrode. Looks like I will start looking into replacing exhaust with new. This is not an issue inadequate maintenance, 99% of boat owner take care of there boats/motors better then what is recommended by the manufacture. Nobody want any problems out on the water. Yamaha customer service is horrible. I understand that the motors are out of warranty, Yamaha should cover the exhaust parts and if the work is done at an authorized Yamaha dealer, issue a flat rated labor cost to replace exhaust components only. Any additional items that need replacement due to wear and tear should be billed out time and materials.

Same issue 2002 F225 replaced one myself in 2007 parts cost over $1800, Yamaha did the other one in 2008 warranty, they knew about the issue, and also had the new Teflon plated parts available, but choose the old green parts. I am now having the same issue again on the one they repaired. Dealer quoted $2500.

Hi, well what I feared was just confirm. I bought a boat last fall with a 2005 F225 four stroque and as you may have guessed, the corrosion issue is on my engine with 460hrs of operation. I disassembled the lower leg to change my water pump and on inspecting the dry exhaust I found the issue as described by every one.

Now in looking at another 2600 min to fix it ! Im very unhappy and yamaha is taking 0 responsibility for a bad product! ! Yamaha is causing millions of dollars of damage for us boaters. If it was a maintanance neglect isise it wouldn't happen to all yamaha owners between 2002 and 2005!!!

Just dropped lower unit on 2004 F225 and have same exhaust housing corrosion. No choice but o bite the bullet and get it fixed. $2,700 estimate from mechanic. What Yamaha has done here with a known manufacturing defect is nothing short of dishonest. They will surely lose more revenue in lost customers over this than what a reasonable recall settlement will cost them.

2006 F225 Same Problem. Will be replacing exhaust stack soon. Would not even care if replacement parts were more like 200.00 but cheapest is 600 even now (1500 when problem began with early models)WTF. Not what I expect from Yamaha. Have owned several Yamaha's in the past, and never a serious problem like this. Have many friends with boats and all have Yamahas. Boats are expensive enough, and Yamaha should be stepping up to the plate on this one and taking the hit, hell I did when I bought it. 20k+ ain't nothing to sneeze at, you can buy a decent car for that. Speaking of cars, if this were a car there would most certainly be a recall. I mean when is the last time you heard of a car being recalled for an exhaust problem that destroys the engine? Answer: NEVER. Love my Yamaha, but not very happy with the company right now.

The next morning we were going out again. Before leaving I checked the oil as usual only to find it was milky. No warning at all. Mechanic says it will cost $5000.00 to repair. Resale value went from 38k/34 k to 10.5 k ( Boat only sale ). No info from Yamaha of problem. Totally maintained by Yamaha Dealer (s)for All 11 years of ownership. ( Engine flushed after most uses ). Most of my fishing done 8 to 15 miles off shore. Lucky to be alive let alone left with a 26,000. loss. New 257 Grady now retails for about 210k/240k.

Had a Grady White 265 with twin f225s purchased From Hobby Lobby in Toms River NJ. Engines overheated simultaneously 3 times, the first 2 times the dealer and Yamaha said I was running in too shallow water. I've been a boater since 1973. I realize boats need water to run. The third time I was 12 miles out in the ocean in 260 feet of water. I think it was deep enough.Dealer never returned calls, Yamaha basically said good luck. Sold the boat to a buyer who knew of the problem, at a substantially reduced price. Wouldn't buy anything from Yamaha ever again. Worst consumer experience ever. I'm in for a class action suit.

I have a 2005 225hp, problems started last summer and continue to today. I am about to take it to a dealer rep in Elberta Ala. and will go from there once we determine the exact damage and cost of repair. Spark plug frozen in place (finally remove and valves are sticking cause the engine to flood. As far as I know it is only on cyclinder one.

I have recently purchased a boat with a 2002 Yamaha 225 four stroke - I new nothing of this problem - the owner may have had this repair done - Unfortunately I bought the boat from a guy who purchased it just to sell it. He did not give me any indication of this repair - he may not have known about the problem??? Does Yamaha keep a list of all repaired engines???
The engine is running well - just changed the thermostats and they had a buildup of salt crystals which most do!

I have not had the issue as of yet, however I bought a digital inspection camera to examine the power head. The things to look for are the metal seals that separate the power head and exhaust system.. If the seals look like they are bending inward you could be looking at a problem..At this point I have not pulled the lower unit down but I have over 800 hours on it (2002 F225) so I guess I have been lucky to date. Note not all engines have this problem. I have had more problems with the trim and tilt seals leaking. Good luck to all!!!

No problems I'm aware of yet, but will be looking. Just beginning to have low throttle issues and am thinking it may be connected. Had other issues with a vapor condenser and Yamaha's solution was to drill a hole in the condenser. Vapors now exhaust out, giving a slight gas smell and I wonder if this is dangerous and up to the clean emissions standards that I bought the engine for. I used to love Yamaha, but perhaps they're not paying attention anymore. Please add me to suit.

I have a 2004 F-225 and my exhaust is leaking and causing the engine to overheat. I would like to know if there was a recall or some other kind of assistance from Yamaha?

I have twin 2004 F225’s. I had them scoped 3 1/2 years ago. The yamaha tech told me there were absolutely no signs of corrosion and possible i am one of the lucky ones that it didnt happen to. This year i had milky oil in my lower units. So i dropped both lower units to get redone. I took a picture up into the midsections and couldnt believe what i saw. Pitting, holes near oil pan, etc. so had it trailered over to a reputable repair shop to be fixed. Upon pulling the Powerheads the tech noticed the ton of corrosion on the bottom of the Powerheads that cannot be seen by a scoping. Now i have to replace the heads, and midsections. I will join the class action suit if someone can let me know how to. I dont have 55k plus to repower so i will be taking a sledge over my head and repairing my motors. It’s disgusting how they know its a manufacturer defect and aren’t held accountable.

I have a 03 Yamaha Four Stroke 225. The motor came on the 04 Cobia boat that I bought back in Dec. 03. I am the original owner and have meticulously maintained this boat. I have 408 hours on the motor. After taking it to have the service done we discovered the exhaust problem. The mechanic explained that I basically need a new motor. The exhaust sleeve has been leaking for awhile and the corrosion is beyond repair. I never received any documents from the dealer or yamaha. Apparently this is a problem that is well known. Is there any recourse at this point?.
