The vehicles experience sheering or stripping of the torque converter which are the result of pressure from the pump shaft, particularly in model years, 2006-2010. NHTSA opens investigation of 2014 & 2015 Jeep Grand Cherokees



The Office of Defects Investigation (ODI) has received 14 complaints alleging that after being placed in Park the subject vehicles have then rolled away from their parked position. The unintended motion has occurred with both the engine off and the engine running.

The model year 2014 and 2015 Jeep Grand Cherokee vehicles are equipped with an electronic gear selector (shift-by wire system). The gear selection is made by pressing the shifter-paddle forward or backwards; the shifter does not move along a gate path as with conventional gear selectors.

A Preliminary Evaluation has been opened to assess the scope, frequency, and safety-related consequence of the alleged defect.

National Highway Traffic Safety Administration opens an investigation of Nissan Versa vehicles pertaining to front suspension coil spring fracture

The Office of Defects Investigation has received 93 complaints (VOQs) alleging incidents of front suspension coil spring fracture in model year (MY) 2008 through 2010 Nissan Versa passenger cars. Preliminary analysis of the complaints indicates that the coil spring failures occur without warning and can happen at any speed. One complaint (VOQ #10663102) reported the passenger-side coil spring fractured while traveling at 65 mph and caused a sudden tire failure by cutting the inner sidewall 360 degrees. Another complaint ( VOQ #10680740) reported the passenger side coil spring fractured while traveling 40 mph and result in tire puncture and brake line failure.

ODI has also received EWR field report information relating to coil spring failures in the subject vehicles.

A Preliminary Evaluation has been opened to assess the scope, frequency and safety-related consequence of the alleged defect.

Approximately 130,000 vehicles are affected by the investigation


FDA Warns Kind LLC about mislabeling and misbranding their products with unsupported nutrient content claims

The FDA sent a letter warning Kind LLC, the maker of a variety of bars, that their Kind Fruit & Nut Almond & Apricot, Kind Fruit & Nut Almond & Coconut, Kind Plus Peanut Butter Dark Chocolate + Protein, and Kind Plus Dark Chocolate Cherry Cashew + Antioxidants products are misbranded under the Federal Food, Drug, and Cosmetic Act (“FDCA”) as improper implied nutrient content claims, because they bear statements suggesting that the product may be useful in maintaining healthy dietary practices, and those statements are made in connection with claims or statements about nutrients.

According to the FDCA, a manufacturer may use the term “healthy” as an implied nutrient content claim on the label of a food provided that the food, among other things, is “low saturated fat”[i.e., the food has a saturated fat content of 1 g or less and no more than 15 percent of the calories are from saturated fat].

The FDA bars found the following products did not meet this standard.

Kind Fruit & Nut Almond & Apricot which contains 3.5 g of saturated fat per 40 g

Kind Fruit & Nut Almond & Coconut product which contains 5 g of saturated fat per 40 g

Kind Plus Peanut Butter Dark Chocolate + Protein product contains 3.5 g of saturated fat per 40 g

Kind Fruit & Nut Dark Chocolate Cherry Cashew + Antioxidants contains 2.5 g of saturated fat per 40 g

The FDA also found Kind’s use of  the phrase “antioxidant-rich” and “good source of fiber” in violation of the FDCA labeling requirements.

WholeFoods settles allegations for overcharging consumers on self-serve foods

City Attorneys of Los Angeles, Santa Monica and San Diego have reached an $800,000 settlement with Whole Foods Markets after a statewide investigation uncovered widespread pricing violations throughout the state of California.

The case grew out of a year-long investigation by state and county Weights and Measures inspectors throughout California. Inspectors  found that the grocery chain was charging more than the advertised price for a wide variety of food items. The problems included: (1) Failing to deduct the weight of containers when ringing up charges for self-serve foods at the salad bar and hot bar; (2) Giving less weight than the amount stated on the label, for packaged items sold by the pound; and (3) Selling items by the piece, instead of by the pound as required by law (such as kebabs and other prepared deli foods)

In addition to the fine, Whole Foods has agreed to: (1) Appoint two “state coordinators” to oversee pricing accuracy at Whole Foods stores throughout California; (2) Designate an employee at every store in the state who will be responsible to assure pricing accuracy throughout the store; (3) Conduct random audits at each of its stores, four times per year, to assure that all prices are accurate and that proper weight is being deducted for all containers; and (4) Charge accurate prices and provide the advertised weight on all items.

Class Action Investigation: Ford investigated for faulty transmission in Focus and Fiesta vehicles



Attorneys have opened an investigation of Ford Motor Company relating to a potential defect in the transmissions of Ford Focus and Fiesta vehicles.

Numerous Ford consumers have complained about defective transmissions on Focus and Fiesta models.  The defect results in shaking or grinding noises; vehicles hesitating and vibrating; transmission noises and the transmission not shifting properly, all of which affect the ability to drive the vehicles and raise safety concerns.

Hundreds of complaints about the Ford transmissions have been filed with the National Highway Traffic Safety Administration.

Investigation opened regarding linkage between testosterone therapy drugs and heart attacks and stroke

Recent reports have raised concerns that testosterone therapy gives rise to an increased risk of heart attack, stroke, and death.  Testosterone therapy (also called androgen replacement therapy) takes the form of pills, injections, and patches or gels that are absorbed through the skin.

A study published in the November 2013 edition of the Journal of the American Medical Association demonstrated an association between testosterone therapy and increased rates of heart attack, stroke, and death. Out of 8,709 male veterans, the rates of deaths, heart attacks, and strokes were 29% higher in the group of men who had received testosterone therapy compared with those who had not.

Based on this data, physicians are becoming concerned over the limited knowledge of the side effects of testosterone therapy, and have called for additional studies.

Conversely, there is little data showing that the testosterone therapy provides a benefit for all but the most severe cases of low testosterone.  Although a growing number of men are being prescribed testosterone therapy for a condition marked as “Low-T”,  some doctors think that the medication is being over-prescribed. One reason for the over prescription of these drugs is the aggressive marketing by pharmaceutical companies

Investigation re: Chrysler’s 2009-2010 Dodge Ram trucks and 2009-2010 Dodge and Dakota trucks over defective rear differential

Investigation of 2013-2014 Toyota Camry, Avalons, Siennas, and Tacomas, and 2014 Corollas or Tundras over potentially defective seat heaters

Toyota announced that it would stop the sale of Camrys, Avalons, Siennas, Tacomas, Corollas and Tundras because of a defective seat heaters that contain padding that does not meet flammability standards. While Toyota felt it was important to prevent the further sale of 36,000 of its vehicles equipped with these seat heaters, it has refused to recall the 2013-14 models it has already sold, claiming it is not a significant safety risk

Ironically, the problem was discovered by a safety agency in South Korea. The Korean Automotive Test and Research Institute, which found that the fabric backing material used near seat heaters did not meet U.S vehicle flammability standards
