Wendy's International Inc. settles class action regarding tans fat levels
The class action lawsuit alleged that Wendy's restaurants' fried food products have higher trans fat levels than advertised. The settlement was the result of a class action filed on July 12, 2007, in the U.S. District Court for the Central District of California, alleging that the fast-food chain misrepresents the trans fat content of its food. The settlement class consists of all persons in the United States who purchased fried food from Wendy's restaurants between June 8, 2006, and the date of the settlement agreement. The fried food includes french fries and fried chicken. The restaurant chain has agreed to eliminate trans fats from its frying process by using nonhydrogenated oils, and subject itself to independent monitoring for one year to assure compliance.
Wendy's also will make a $1.8 million donation to be distributed to the American Cancer Society, the American Diabetes Association, the American Dietetic Association and the American Heart Association. The company will not admit liability or wrongdoing.
