A Pennsylvania federal judge approved five separate settlements worth $95,925,000, bringing the total settlement amount reached in a direct purchasers' price-fixing class action to $120,730,000 (In re: OSB Antitrust Litigation, No. 06-826, E.D. Pa)
Direct and indirect purchasers of oriented strand board (OSB) filed class action complaints alleging horizontal price-fixing conspiracy among nine OSB manufacturers.The purchasers maintained that the manufacturers violated the Sherman Antitrust Act. On Aug. 3, 2007, U.S. Judge Paul S. Diamond of the Eastern District of Pennsylvania certified a litigation class of customers that directly purchased OSB structural panel products from the manufacturers. Three of the defendants - Ainsworth Lumber Co., J.M. Huber Corp. and Georgia Pacific Corp. - settled the claims with the plaintiffs last year.
On Dec. 9, the judge issued five orders granting final approval of the settlement among the following OSB manufacturers: Grant Forest Products Sales Inc. and Grant Forest Products Inc. (collectively, Grant Forest), Potlatch Corp., Weyerhauser Co., Norbord Industries Inc. and Louisiana-Pacific Corp.
In all of the orders, the judge said approval of the settlement is appropriate because of the complexity, expense and likely duration of the litigation. The judge added that continued litigation would have meant incurring significant additional expenses and delay before recovery, if any
