Class action filed against Apple Inc. alleging that the display screens on its iMac desktop computers are defective and show unwanted vertical lines
The plaintiff alleges that the defect is caused by a faulty transistor or connection on the back of the screens which causes the screens to fail at an unusually high rate in excess of industry standards. The plaintiff claims that Apple is aware of the latent defect but has repeatedly denied warranty claims relating to the problem
The plaintiff seeks to represent a nationwide class of all people and entities who purchased, not for resale, an Apple iMac. He seeks damages for violations of Section 17200 of the California Business and Professions Code, the California Consumer Legal Remedies Act, unjust enrichment and breach of implied warranty of merchantability. He also seeks to require Apple to establish a program to repair and replace defective iMac display screens and to reimburse class members for warranty claims based on the alleged defect that were denied.
