The class action lawsuit was brought on behalf of those who purchased products and/or services, between June 1, 2009 through and including December 9, 2009.
The complaint alleges that MetroPCS offered unlimited international calls for a mere $5 a month, on top of the $45 flat fee attached to the company's "Ultimate Unlimited" plan, but never mentioned to consumers that the plan excludes calls to many foreign destinations. According to the complaint, class members bought the service "in reliance of such advertisements." The complaint accuses MetroPCS of using "bait and switch/deceptive trade practices," including misleading advertising, to lure customers into signing up for the plan. The complaint alleges that MetroPCS is in violation of New York General Business Law Section 349 and Section 350 and substantially similar statutes of different states.
